Reservation Terms - Roadster & Speedster.

These Reservation Terms are between Longbow Motorcar Company Ltd, of 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, company number 15044627 (“Longbow”, “we”, “us”), and you, the person making a Reservation (“you”, the “Reservation Holder”).

1. Your Reservation

Placing a Reservation and paying the Reservation Payment secures your place in the queue for a Longbow Roadster or Speedster. It is not a purchase, a finance agreement, or a promise of a delivery date. It simply holds your priority until you are ready to configure and order your car.

Your Reservation becomes effective once you have placed it at www.longbowmotors.com and we have received your Reservation Payment.

2. Cancelling your Reservation

You can cancel at any time before you sign a Purchase Agreement with us, for any reason, simply by emailing enquiries@longbowmotors.com.

  • Within 14 days of placing your Reservation: if you are a consumer based in the UK or the European Union, we will refund your Reservation Payment. This is your statutory cooling-off right.
  • Any other cancellation: we will refund your Reservation Payment less our actual payment processing costs, which are the fees our payment provider keeps when a payment is refunded. We will tell you this amount if you ask us.

We aim to send every refund within 14 days of your cancellation, though your bank's own processing times may vary.

We may also cancel your Reservation at any time before a Purchase Agreement is signed. If we do, the same refund promise above applies to you.

3. What happens next?

As production of your car approaches, we will invite you to configure your car. We will then send you a Purchase Agreement setting out the final purchase price, taxes, duties, delivery and any other charges. Nothing is finalised and no vehicle is bought or sold, until you sign that Purchase Agreement. If you go ahead, your Reservation Payment is applied towards your order.

4. The detail

4.1 Purchase price estimates

Any purchase price we give you before you configure your vehicle is only an estimate. Specification, features and hardware may change substantially before then. Your actual Purchase Price is confirmed once you have configured your vehicle.

4.2 Delivery

Both Roadster and Speedster are still in development. We cannot guarantee a delivery date, or that either car will be delivered at all, until you have signed a Purchase Agreement.

4.3 How we hold your money

Your Reservation Payment is held in a segregated account. We do not use it as working capital, but it is not held in trust or in escrow, and it does not earn interest.

4.4 Transferring your Reservation

Your Reservation is personal to you. You cannot transfer or assign it to anyone else without our prior written approval. We may transfer our rights and obligations under this agreement to another company or entity, but that will not affect your rights under it.

4.5 Personal use only

Your Reservation is for your own personal use, not for resale or commercial purposes. We are not liable for any loss of profit, business, business interruption, or business opportunity connected with your Reservation.

4.6 Limitation of liability

We are not liable for indirect, incidental, special or consequential losses arising from this agreement. If something does go wrong, your remedy is limited to getting your Reservation Payment back, less any lawful deduction described in section 2. This does not affect, and we do not try to exclude: liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors; liability for fraud or fraudulent misrepresentation; or any right you have under the law that cannot lawfully be excluded or limited, wherever you live.

4.7 Your data

We will ask you for personal information so we can manage your Reservation, in line with our Privacy Policy at www.longbowmotors.com, which explains your rights under UK GDPR, EU GDPR and other applicable data protection and privacy laws.

4.8 Your legal rights are not affected

Wherever you live, this agreement does not take away any right you have under the mandatory consumer protection laws of your own country or state, for example in the UK, an EU member state, or a US state.

4.9 Resolving a disagreement

If a dispute comes up, please email us first at enquiries@longbowmotors.com with what is wrong and how you would like it resolved. We will try to sort it out between us in good faith, including through mediation, for up to 60 days. After that, either of us may refer it to arbitration under LCIA Rules, seated in London and conducted in English before a single arbitrator, but only if we both agree to arbitrate. Arbitration is optional, not compulsory, and it never removes your right to go to court instead, including the courts local to you.

4.10 Governing law

This agreement is governed by the laws of England and Wales, without affecting the consumer protection rights described in section 4.8.

4.11 The whole agreement

This document, and anything it expressly refers you to, is the entire agreement between us about your Reservation, and replaces anything discussed before, whether written or spoken. If any part of it is found unlawful or unenforceable, the rest stays in effect.
